1.2.5. "ASL"
Die Art und Struktur des WWW unterstützt die Entstehung von "open source"-Projekten, d.h. von Software, die nicht nur als Binary weitergegeben wird, sondern in den Sourcen für jedermann zugänglich ist. Auch bei Open-Source-Software müssen aber die Lizenzbedingungen geprüft werden. Open-Source bedeutet nicht unbedingt  kostenlos. Bedingungen können an die Weitergabe des intellektuellen Eigentums, den Umgang mit eigenen Erweiterungen oder der Zahlung von Lizenzgebühren beim kommerziellen Einsatz der Software bestehen.

Im Fall des Apache-Webservers wurde eine spezielle "Apache Software License" (ASL) definiert. Deren wesentlichen Inhalte sind:
  • Die Lizenz muss immer mit weitergegeben werden (in Sourcen oder Binary).
  • Die Benutzerdokumentation muss einen Hinweis auf die Apache Software Foundation beinhalten.
  • Abgeleitete Produkte dürfen ohne schriftliche Erlaubnis nicht den Namen "Apache" beinhalten.
  • Die Software beinhaltet einen vollständigen Haftungsausschluss.
  • Der Hinweis auf die ursprünglichen Entwickler am NCSA ist im Nachsatz noch vorhanden.
